FPN [flytipping] received out of date to pay initial fine

Hi there, I've decided to pay the initial fine but the time for paying the initial fine has lapsed. Letter dated 27th Jan, 14 days given, letter received 11 Feb. No postmark on letter. Can they do this? Do I have a right t o be able to pay the initial fine as its double the amount as of 2 days before I received it! Thanks for any and all replies,

- Phone the council and ask to talk to the Officer who issued the fine.
- Explain the letter was only just received and you only just realised what must have happened. 
- Apologise for not checking your handyman was telling the truth when he said he was licensed.
- Offer his contact details before you're asked for them.
- If the conversation's going well, ask if there's any chance of being let off with a warning for a first offence.
- If they say 'no', ask nicely if you can make the payment at the reduced rate. 

- Stop talking about 'rights'... you've admitted that you screwed up and you've decided to pay the fine - as per the earlier thread, you're hoping some goodwill means they'll let you off with a warning and you catch more flies with honey...

Thanks NewShadow. Just seems a bit odd I now have to 'act nice' and hope they don't hammer me (like the guy in that article you sent me who also admitted not checking the credentials of the person taking away his rubbish) instead of giving me a fair opportunity to pay the initial fine. Stop talking about 'rights' eh.

The title isn't self-explanatory as it gives no clues about what sort of FPN you're talking about. Would have made much more sense just to continue the existing thread.

Unfortunately for you the council is under no obligation to believe you only got the letter yesterday. It’ll have been posted a few days before that on their system. So yes, being nice to them is really the only chance you stand of being able to pay the lower penalty. I’d be on the phone by now to them to explain what happened and try and get the contractor fined not yourself, but it really is just an outside chance. They may not really care as at the end of the day it is your responsibility to check, as annoying as that is.

Are you saying from one type of FPN to another, there will be different expectations about a 'right' to pay within the initial period?

Given they're all governed by completely separate legislation, it would be a bit of a coincidence if the rules were all identical.
